Terms and Conditions and Privacy Policy

These Terms and Conditions and Privacy Policy as may be amended from time to time (hereafter, “Privacy Policy”), disclose the privacy practices regarding all information gathered from or about you ("Personal Information"), including in person, via any websites, mobile applications, social media pages, written or typed questionnaires, electronic transmissions, short message services, facsimiles, telephonic communications, and all services, software functionality, or materials (collectively, the “Sources“) collected by or on behalf of K. Hovnanian Companies, LLC or its affiliates (“Hovnanian“, “us” or “we“).

We understand the importance that our customers place on privacy - we take your privacy seriously, too. We have designed this Privacy Policy to describe our information-gathering and dissemination practices. You consent and agree to this Privacy Policy when you access or use any Sources or communicate with us. If you do not consent or agree to this Privacy Policy, please do not access or use any of our Sources or communicate with us (as a basis for processing your Personal Information is your consent to this Privacy Policy). If you wish to withdraw your consent, please follow the procedures set forth below to withdraw your consent (in whole in or part) by following our opt-out procedures.

Please note that we reserve the right to review and update this Privacy Policy from time to time. If we make any material changes to the Privacy Policy, a notification will be made by means of a general notice displayed on certain Source(s) prior to the change taking effect. If you use any Sources or communicate with us after any such update, you will be deemed to have agreed to the updated Privacy Policy.

Information that we collect about you.
Information You Provide. When you register for an account with or on any Source(s) or purchase a home, product, or service from us, or contact us, we may collect, or you may provide to us, the following information that may identify you:

Passively Collected Information. When you access certain of our Sources, we automatically collect your computer or device’s internet protocol (IP) address and other technical information about your computer or device and website usage, including your browser type and version, geographic information, time zone setting, and operating system and platform. We also use cookies on certain of our Sources. For more information, please see the “Cookies and Other Tracking Technologies” section below.

Information Collected From Third Parties. We may work with certain third parties to receive information about you, including your name and contact information. This may help us, for example, to fulfill your service requests, or to provide you with services that may be of interest to you.

Our Privacy Policy is the same for former customers, current customers and prospective customers.

Cookies and other tracking technologies that we use.
We and our Service Providers (as later defined) use cookies, beacons, embedded scripts and local shared objects in connection with certain of the Sources.
  • Cookies are small text files that are stored on your computer or device when you visit for example a website. Cookies allow a website to recognize a particular device or browser. The use of cookies is a standard practice among websites to collect information about visitors’ activities while using such website.

  • Beacons are small graphical images (also known as “pixel tags” or “clear GIFs”) that may be included on certain of our Sources and typically work in conjunction with cookies to identify users and user behavior.

  • An embedded script is programming code that is designed to collect information about your interactions with certain of the Sources, such as the links you click on. The code is temporarily downloaded onto your computer or device from our web server or a third-party service provider, is active while you are connected to the applicable Sources, and is deactivated or deleted thereafter.

These technologies are used in analyzing trends, administering certain of the Sources, services and products, tracking users’ movements around certain of the Sources, and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies on an individual as well as aggregated basis.

We do not monitor or identify “do not track signals” from your devices and such signals will not impact the operation of the Sources. Even if you are using a device that sends a "do not track signal," we may collect, use and share Personal Information, provided that our actions are consistent with this Privacy Policy.

We use cookies to remember users’ settings, market products and services to you, and for authentication purposes. To manage the cookies that are placed on your computer, you may configure your internet browser to refuse, accept or delete cookies from our Sources at any time. The help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Please note that if cookies are disabled or removed, not all features of certain of our Sources will operate as intended.

Third-Party Advertising Services. We may work with third parties that may use technologies such as cookies and local stored objects as described above to gather information about your activities on certain of the Sources and elsewhere on the internet to provide you with relevant advertising based upon your browsing activities and interests. This type of advertising is sometimes called interest-based advertising or targeted advertising. If you wish to not have this information collected and used for interest-based advertising, you may opt-out by clicking here; for third parties that participate in the TRUSTArc (formerly TRUSTe) opt-out tool. If you wish to opt-out from this type of advertising for companies that participate in the Digital Advertising Alliance (“DAA”), you can do so here. Third-Party Analytics. We may also use Service Providers (such as Google Analytics), that may use cookies or other technologies to collect information about your online activities across this and other sites over time for non-advertising purposes such as those described above. What We Do With the Information We Collect.
We use Personal Information that we collect in several ways, including, for example:
  • Information Provided by You Upon Registration and Making a Purchase. We may use this Personal Information to administer your access to one of the Sources, verify your identity, and provide our products or services to you.

  • Information Provided When You Contact Us. We may use this Personal Information to understand and respond to your question or comment.

  • General Uses. We may also use your Personal Information to improve and personalize your experience with us, for us to send you information about us and to keep you informed of our other products and services that may be of interest to you.

  • Passively Collected Information. We may use passively collected information to monitor and maintain the performance of certain of our Sources, analyze trends, usage and activities in connection with our services, validate users and ensure their technological compatibility with users, and optimize our marketing efforts.

  • Aggregate Data. We may use certain or all of your Personal Information to create aggregate data which does not include any personally identifiable information and which cannot be used to specifically identify you. For example, aggregate data may include data that describes the general demographics, usage or other characteristics of certain Sources' users. We reserve the right to transfer or keep aggregate or group data about our Sources' users for lawful or legitimate purposes, such as for the purposes described in this section.

  • Information Collected From You. We may use or share aggregated or de-identified information collected from you in our discretion, such as to provide analytics and benchmarking. We reserve the right to transfer or keep aggregate or de-identified data about you for lawful or legitimate purposes, such as for the purposes described in this section.

Who We May Share Your Personal Information With.
We may share your Personal Information with our affiliates and with third parties as described in this Privacy Policy. We reserve the right to transfer or sell data, including aggregated or de-identified data derived from your Personal Information, for lawful purposes in our sole discretion.
  • We may share Personal Information with affiliated businesses.

  • Service Providers. We, like many businesses, sometimes hire other companies (“Service Providers“) to perform certain business-related functions. Examples include mailing information, maintaining databases, processing credit card transactions, and hosting services. When we employ a Service Provider to perform a function of this nature, we provide it with certain information to perform its functions, which may include Personal Information and other information that you provide to us or that we collect. These Service Providers are authorized to use your Personal Information only as necessary to provide these services to us.

  • Legal Requirements. We may disclose Personal Information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a subpoena or similar legal obligation, (b) protect or defend our rights or property, (c) act in urgent circumstances to protect the personal safety of users of any Sources, or the public, (d) help protect against legal liability, or (e) as otherwise required or permitted by law.

  • Business Transfers. As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, total or partial sale of assets in bankruptcy or similar event, Personal Information may be part of the transferred assets.

  • Some of our pages utilize framing techniques to serve content to you from third parties while preserving the look and feel of our Sources. When you interact with content from third parties displayed on any of our Sources, please be aware that you are providing your Personal Information to these third parties and it will be governed by their respective privacy policies and terms and conditions.

Our Opt-Out Policy.
Email Marketing. To stop receiving newsletters or marketing communications from us or to opt out of having information, such as your email address shared with third parties, please use the “unsubscribe” mechanism provided in the communication or send an e-mail to CustomerSupport@khov.com along with the information necessary for us to process your request.

Service-Related Announcements. We may also send you service-related email announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Because these emails are not promotional in nature, you do not have an option to opt out of these communications.

Our Policy on Accessing, Correcting, Updating or Deleting Personal Information, and Deactivating Your Account.
You may request to access, correct, update, or delete certain of your Personal Information or deactivate your account by emailing our Customer Support at CustomerSupport@khov.com with information necessary for us to process your request. While reasonable efforts will be made to delete all of the Personal Information as you may request, in certain circumstances retention of certain of your Personal Information may be required, including as required by law. Please see below regarding our retention policy.

General Terms and Conditions.
Other Websites. The Sources may contain links to third party businesses, or third party owned or operated websites. We are not responsible for the privacy or security practices or the content of such third parties or their websites. We suggest that you contact these third parties directly for information regarding their privacy, security and data collection and retention, and distribution, and other policies and terms and conditions prior to providing them with any information.

Testimonials. We may post customer testimonials on the Sources which may contain personally identifiable Personal Information such as a customer’s name. We first obtain your consent, prior to publically posting a testimonial with your personally identifiable Personal Information. Thereafter, if you want to remove your personally identifiable Personal Information that may be publically displayed on any of the Sources, please send your request to CustomerSupport@khov.com.

Social Media Widgets. Our Sources may include social media features, such as the Facebook “Like” button and widgets such as the “share this” button or interactive mini-programs that run on certain of our Sources. These features may collect your IP address, which pages you are visiting on certain of our Sources, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on certain of our Sources. Your interactions with these features are governed by the privacy policy of the company providing them.

SECURITY AND RETENTION. WE TAKE COMMERCIALLY REASONABLE STEPS TO HELP PROTECT PERSONAL INFORMATION FROM LOSS, MISUSE, UNAUTHORIZED ACCESS, USE, DISCLOSURE, ALTERATION AND DESTRUCTION. HOWEVER, NO INTERNET OR ELECTRONIC TRANSMISSION IS EVER FULLY SECURE OR ERROR FREE.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, IN NO EVENT WILL HOVNANIAN BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY, AND HOVNANIAN DISCLAIMS ANY AND ALL, DAMAGES, LOSSES, CLAIMS, LIABILITIES, PENALTIES, COSTS, EXPENSES AND ATTORNEYS' FEES, INCLUDING, WITHOUT LIMITATION, DIRECT, SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, CONSEQUENTIAL OR EXEMPLARY DAMAGES IN ANY WAY RELATING TO OR ARISING FROM THE MISUSE, DISCLOSURE (EITHER VOLUNTARY DISCLOSURE BY HOVNANIAN, OR UNINTENTIONAL DISCLOSURE VIA A DATA OR SECURITY BREACH), ALTERATION OR DESTRUCTION OF PERSONAL INFORMATION OR ANY BREACH OF SECURITY OR FOR THE UNAUTHORIZED ACCESS OR USE OF PERSONAL INFORMATION OR FOR ANY TECHNICAL FAILURES OR PROBLEMS, ERRORS IN PERSONAL INFORMATION, INTERRUPTION IN OR TERMINATION OF THE OPERATION OF ANY SOURCES, OR ANY RESULTS OF ANY SUCH FAILURES, PROBLEMS, OR ERRORS.

In addition, e-mail sent to or from any of our Sources may not be secure, and you should therefore take special care in deciding what information you send to us via electronic transmission. Please keep this in mind when disclosing any Personal Information to us or to any other party via the Internet. When you enter sensitive information on our order forms or login credentials (such as username and password) on our platform login, we encrypt the transmission of that information using secure socket layer technology (SSL).

Your Personal Information will be stored in the United States and will be subject to laws applicable in the United States. Our Sources may not be available or appropriate for use in countries other than the United States. If you choose to access one of our Sources from a country other than the United States, you do so at your own risk and with the understanding that Personal Information may be collected, used, disclosed or stored in the United States. If you are accessing our Sources in a country other than the United States, you acknowledge that our Sources are operated in the United States and your Personal Information may be transferred to and processed in the United States, where the privacy laws may be different than those in the country from which you are accessing our Sources.

Minors. Any person using the Sources must be 18 years of age or older, and no person under 18 years of age is permitted to use any Source or submit their Personal Information at any Source.

Arbitration. ANY CLAIMS, DISAGREEMENTS, OR DISPUTES RELATING TO THE SOURCES OR THIS PRIVACY POLICY, INCLUDING WITHOUT LIMITATION THE COLLECTION, USE, DISCLOSURE (WHETHER VOLUNTARY, UNINTENTIONAL OR AS A RESULT OF UNAUTHORIZED ACCESS) OR STORAGE OF YOUR PERSONAL INFORMATION, SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION PURSUANT TO THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA). ANY RIGHTS YOU MAY HAVE WILL BE DETERMINED BY A NEUTRAL ARBITRATOR, AND NOT BY A JUDGE OR JURY. YOU ARE THUS WAIVING YOUR CONSTITUTIONAL RIGHT TO HAVE ANY CLAIMS, DISAGREEMENTS, OR DISPUTES DECIDED IN COURT BEFORE A JURY OR JUDGE, AND INSTEAD ARE ACCEPTING THE USE OF BINDING ARBITRATION. THE ARBITRATION SHALL TAKE PLACE IN THE STATE OF NEW JERSEY, UNLESS YOU REQUEST, IN WRITING, A DIFFERENT LOCATION REASONABLY RELATED TO THE CLAIMS, DISAGREEMENTS, OR DISPUTES AND IN WHICH STATE WE MAINTAIN A PHYSICAL BUSINESS OFFICE. THE ARBITRATION SHALL BE CONDUCTED BY ONE ARBITRATOR WHO IS SELECTED PURSUANT TO THE RULES OF THE AAA FROM THE AAA ROSTER OF ARBITRATORS, USING THE AAA ARBITRATOR SELECT LIST AND APPOINTMENT. THE AWARD OF THE ARBITRATOR SHALL BE FINAL AND JUDGMENT UPON THE AWARD SHALL BE ENTERED IN A COURT OF COMPETENT JURISDICTION IN THE STATE OF NEW JERSEY, OR IN THE STATE IN WHICH THE ARBITRATION TAKES PLACE. THE ARBITRATION SHALL NOT BE CONSOLIDATED OR COMBINED WITH ANY OTHER ARBITRATION, NOR CAN YOU PROCEED IN THE ARBTRATION ON A REPRESENTATIVE BASIS OR CAPACITY FOR OTHER PARTIES. YOU ALSO WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION BROUGHT IN COURT, OR TO ARBITRATE OR PARTICIPATE IN ARBITRATION ON A CLASS BASIS. EACH PARTY WILL BEAR ITS OWN ATTORNEYS’ FEES AND COSTS IN CONNECTION WITH ANY ARBITRATION, AND ANY COURT PROCEEDING IN CONNECTION WITH THE ENFORCEMENT OF THIS ARBITRATION PROVISION OR ENTRY OF JUDGMENT ON AN ARBITRAL AWARD. ANY DISPUTES REGARDING THIS ARBITRATION PROVISION SHALL BE RESOLVED BY THE ARBITRATOR. THIS PRIVACY POLICY IS GOVERNED BY THE LAWS OF THE STATE OF NEW JERSEY, AND CHOICE OF LAW PRINCIPLES SHALL NOT APPLY.

Active Lifestyle Communities


K. Hovnanian's® Four Seasons communities are intended to provide housing primarily for residents 55 years of age or older. Additional restrictions, including limitations on the ages of additional permanent and temporary residents of a home, may apply. All K.
